Introduction

Welcome to use the software and related services provided by Invgarden Bilişim Teknolojileri Arge Ltd. Şti. (“Bilicra Care” “we” or “us”).

The software and related services provided to you through our legally owned customer application labeled “Bilicra Care” refers to the following.

Bilicra Care is a tool-based application and content service platform for home users, operated including but not limited to basic functions such as location queries, video calling, chat messages, remote management of equipment, personalized recommendations, sending information, interactive communication and other functions. The Bilicra Care User Agreement (“this Agreement”) is an agreement between you and us your registration, login, use of our services (collectively, “your use”).

In order to better serve you, please read this Agreement carefully before using it, especially the clauses regarding exclusion or limitation of liability, licensing and use of information, to activate and use custom single service, applicable laws and dispute resolution, etc. Among them, you should focus on reading the bolded clauses such as exclusion or limitation of liability. If you are under the age of 18, please read and fully understand this agreement with your legal guardian and use our services only after obtaining verifiable consent from them.

By accessing or using our services, you agree to be bound by these terms. Otherwise, you may not access or use our services. If you accept or use our services, you are deemed to have already read and agree to be bound by this Agreement and the services Agreement and the rules of other related software, including but not limited to the Privacy Policy.

Bilicra Care and Related Services
- When you use our Services, you may obtain our client application through pre-installation, download by authorized third parties, etc. If you have not obtained the software in the ways we have mentioned, we cannot guarantee that the unofficial version of the software can be used normally and we cannot provide a remedy for the damage you have suffered.
- We can develop different application versions for different terminal devices. You should obtain, download and install the appropriate version according to the actual device situation. If you no longer use our services, you can uninstall the corresponding application.
- In order to provide a good user experience, we will update or modify our services from time to time (including but not limited to software changesupgradesfunctional improvements, new development, software replacement, etc.), you can update the relevant version depending on your needs. In order to ensure the security of our services and improve user services, after partial or complete updating of our services, we will remind you in an appropriate manner. Including but not limited to system prompts, announcements, website letters, etc. and you have the right to choose whether or not to accept the updated version. , some functions of our services will be restricted or

normally used.

You may not make any unauthorized access or use of our services in any way, including, but not limited to, adaptation, reproduction, dissemination, vertical search, mirroring or trading, unless authorized by us in advance in writing.
In order to use our services, you need to prepare your own terminal device (mobile phone, tablet, etc.). When you open it on the terminal device, you are considered to be using our services. In order to realize the full functionality of the software, you need to cover the necessary costs of the terminal equipment (such as data charges, Internet access charges).
We grant you a personal, non-transferable, non-exclusive, non-commercial, limited license to use and access the Services only as permitted herein.

We reserve all rights not expressly granted to you in these Terms. Except as permitted through the Services or as authorized by us in writing, your license does not include any rights we do not specify. Also, if we do not exercise any of the rights set out above, this does not constitute a waiver of that right.

You do not need to register when using our services, but the main functions or services will be affected. In the meantime, we hope you understand that to enable you to better use our Services, to protect your account security, and certain features and/or individual services (such as the comment service) will require you to provide your real identification information and register with your real name in accordance with relevant national laws and regulations before you can use them.

Your Account
- Our Services provide you with a registration channel. You have the right to choose a legal combination of characters as your account and to set your own password that meets security requirements. The account and password you set are the credentials for you to log in and use our services.
- You understand that the account you set up must not violate national laws and regulations and our respective rules, and that you must not take any action that violates national interests, harms the legal rights and interests of other citizens, and harms social morality. You understand that your username, avatar

and profile and other contact information is legal and do not use someone else’s information.

You may not maliciously register your account (including but not limited to frequent and bulk registration, etc.). We reserve the right to review the information you submit.

Only you have access to your Bilicra Care account, and you are prohibited from giving, lending, borrowing, renting, leasing, transferring, selling or otherwise allowing others to use the account without our prior written consent. If we determine or have reasonable grounds to suspect that you are not the original registered owner of the account, we have the right to suspend or terminate service to the registered account or cancel the account immediately to protect account security.
You are solely responsible for the associated information and for everything related to your account, including but notany data changes, posted comments, payments and other actions. You must maintain the security of your account and notify us immediately if you notice or suspect that someone has accessed your account without your permission.
When you forget your password, you can follow the instructions to get your password back. We would like to remind you that it is preferable to use only the cell phone number verification followed by the security issue. You must keep your account and password properly, if it is hacked or lost for your own reasons, we accept no responsibility for it.
When using your account, you should keep in mind the relevant information you fill in (account number, password, security questions, etc.). In accordance with relevant national laws and regulations, you may be required to fill in real identification information (such as identity verification) to use some functions of our services and pay attention to update the relevant information in a timely manner. If the materials you submit or the information you provide is not standardized or compliant, we have the right to refuse to provide you with the relevant functions. You will not be able to access or use our Services.
In addition to registering with Bilicra Care, you are also authorized to use other lawful software, including but not limited to our and/or our affiliated software, and third party software user accounts registered in real names to log in and use Bilicra Care, unless the third party software or platforms have restrictions or prohibitions. When you log in with the existing account mentioned above, you must ensure that such account is registered in a real name and the same applies to this agreement.
Not only can you log in and use Bilicra Care, but you can also use your account login for other software and services provided by our affiliated companies. We remind you that when you log in with your Bilicra Care account and use the aforementioned services, you are bound by the User Agreement and other terms of agreement of the original provider.
To increase your content visibility and publishing efficiencyyour account on this software/website

or we are authorized to automatically publish all content generated by the relevant account to other software and websites operated by us and/or our affiliates. Transactions that you post, modify and delete on this software/website will be synchronized to the other software and websites mentioned above. When you register or log in to the products and websites, you must comply with the software and website’s own “User Agreement” and other contractual terms if operated by us and/or our affiliates (if any) through a registered account or a third party software user account

Once you have completed the registration, login and reasonable and necessary authentication process with Bilicra Care, you may browse and change the personally identifiable information provided by you at any time. Due to security and identity considerations (account or password recovery services, etc.), you may not be able to change the initial registration information and other verification information you provided when you registered. You may request deletion of your account, and we will assist you after we have completed reasonable and necessary verification of personal identity, security status, device information, etc., unless otherwise required by law and regulations.
To take full advantage of account resources, if you do not log in for the first time in a timely manner after registration or if you do not use your account for more than six months, we will take your account back.

Protection of User Personal Information

We work with you to protect your personal information (which can identify a user independently or in combination with other information). For us, protecting users’ personal information is a fundamental principle. In order to provide you with a better service and related technical support, you may be required to provide personal information (including but not limited to name, phone number, location information, etc.) when you use Bilicra Care. We may require you to provide your personal data and certain other information about yourself set out in the Privacy Policy

We will use encryption technology, anonymization, other technical measures and security measures compatible with Bilicra Care

User Code of Conduct
- User behavior requirements

When using our Services, you be responsible for everything that happens in connection with your account. Except as permitted through the Services or as authorized by us in writing, your license does not include the right to do the following:

Use any plug-in, system or third-party tool not authorized or licensed by us to interfere with, destroy, modify or affect the normal operation of our Services.
Doing anything against our services that compromises computer network security, including but not limited to the following:

Illegal intrusion into other people’s networks, interference with other people’s normal functions, theft of network data, and other actions that compromise network security
Network intrusion, interference with normal network functions and protection measures, and

programs and specifically designed for stealing network data, etc.

You know others are taking actions that compromise network security, yet you provide assistance with technical support, advertising promotion, payment reconciliation, etc.
Using unauthorized data or accessing unauthorized servers/accounts
Entering public computer networks or other people’s computer systems without authorization and deleting, changing and increasing the stored information
Unauthorized attempts to detect, scan, test for weaknesses in the “Bilicra Caresystem or network, or other actions that undermine network security
Attempting to interfere with or disrupt the normal operation of the “Bilicra Care” system or website, intentionally spreading malicious programs or viruses, and other actions that disrupt or interfere with normal network information services
Forged TCP/IP packet name or partial name
Attempting to reverse engineer, disassemble, decompile or otherwise attempt to find the source code of our services
Maliciously register accounts for our services, including but not limited to frequent and bulk registration
Violate laws and regulations, this agreement, our relevant rules and

other actions that violate the legal rights and interests of others.

If we have reason to believe that your actions are or may be in breach of the above agreement, we may independently assess and address this, terminate the service for you without prior notice, and pursue any relevant legal responsibilities.

Content Features
- Once you have completed the registration process in accordance with the regulations, you can log in to Bilicra Care with your registered account or our partner platform account to publish content, follow comments, etc.
- While promoting the development of the business of information publishing, interactive communication and comment posting, we will continue to strengthen relevant information security management capabilities, enhance the self-discipline of information publishing, comment posting, and effectively fulfill social responsibilities, comply with national laws and regulations, respect the legitimate rights and interests of citizens and social order.
- The content you comment, post and publish must consciously comply with these requirements, such as laws, regulations, social order, social morality, socialist system, national interests, legitimate rights and interests of citizens, moral traditions and authenticity of information, etc. You also agree and undertake that you will not produce, copy, publish or disseminate the following information prohibited by laws and regulations:

To overthrow state power, overthrow the socialist system, promote secession and undermine national unity;
Those who harm national honor and interests;

Those who generate and spread rumors and misinformation, and those who disrupt economic and social order and social stability;
Those who spread violence, obscenity, pornography, gambling, murder, terrorism or incitement to crime;
Violates the legal rights and interests of minors or violates the rights and interests of minors

Those who take or record photographs of others without permission, in violation of the legal rights of others;
Those involving fear, violence, high risk, endangering the physical and mental health of oneself or others;
Those who compromise network security, those who use the network to compromise national security, honor and interests;
Those who insult or others, violate their legal rights;
Violent intimidation, threats and the search for human flesh against others;
Those containing personal privacy, information or data;
Those who spread dirty words and damage the social order;
Violators of privacy, reputation, portrait rights, intellectual property rights, etc;
Commercial advertisement-supported program or akin advertisement-supported software distributors spread leads, spam and spam;
Those who comment in a language other than the language commonly used on this site;
Those who publish meaningless information or use character combinations to deliberately evade technical controls;
Violate laws, regulations, policies, social order, interfere with our normal operation, or violate the legitimate rights and interests of others or third parties.
- We have established a public complaint and reporting platform. You can complain to us according to our public complaint reporting system, such as any illegal acts, illegal communication acts, illegal and harmful information, etc. We will promptly accept and handle your feedback to jointly build a clean network environment.

Information Content Specification
- You may not, without our written consent, authorize, permit or assist any third party to do any of the following things with respect to the information content on our services under this agreement:

Copy, retrieve and use the information content on Bilicra Care for commercial purposes, including but not limited to promotion, further reading and page views;
Unauthorized editing, organizing, sorting and displaying the information content received from Bilicra Care in media other than the source page of our services;
Adopting identification methods, including but not limited to any custom, code, etc., to help third parties or to do it on your own to influence the information content of our services, such as redirecting readings, transferring and hijacking our traffic;
Other illegal ways to obtain or use information content from Bilicra Care

actions.

With our written consent, your actions that share and transmit information content from Bilicra Care must meet the following specifications:

Related data such as hot words, hit rates, categories, searches, hits, reads, etc. obtained through browsing and statistics, you may not transmit or disclose them to any third party without our prior written consent.
You may not make any changes to the resource pages of our services, including but not limited to the home page (profile page) link and the advertising system. Also, you are not allowed to block, add, pop-up, etc. in any way for the display of the resource pages of our services;
Safe, effective and strict measures must be taken to prevent the content of information obtained from our Services from being illegally obtained by third parties in any way, including but not limited to “spider” programs;
Do not use the relevant data content for purposes outside the scope of ourauthorization, such as and commercial use, or disclose, provide or allow third parties to use it in any way;
The act of sharing, transmitting and copying the content of our service information with any third party must comply with other rules and standards set by us.

Default Processing
- In the event that you violate this agreement or other terms of service, we have the right to independently assess and take measures such as prior warning, refusal to publish, immediate cessation of information transmission, deletion of follow-ups, banning short-term conversation, and restricting some or all functions of the account until it is permanently closed. We have the right to announce the results of the action and to decide whether or not to resume the users’ respective account based on the actual situation. We will report suspected violations of laws and regulations and suspected criminal offenses to the relevant competent authorities according to law and cooperate with the relevant competent authorities for investigation.
- If you breach any provisions of this agreement or other terms of service and a third party complaint or lawsuit claim, you be solely responsible for it. If we and our affiliates pay damages to any third party or if we are penalized by a government authority because of your illegal, infringing or breach of contract, you must fully compensate us and our affiliates for all damages we incur.
- Bilicra Care respects and protects users’ intellectual property, reputation, name, privacy and other legal rights. You must guarantee that the texts, images, videos, audios, links, etc. that you upload while using our Services do not violate the following rights of any third party.

Otherwise, we have the right to remove the allegedly infringing content. You are solely responsible for all claims made by third parties; if we and our affiliates suffer any damages (including economic, business reputation, etc.) as a result of your wrongful act, you must fully compensate us and our affiliates for any damages we suffer.

Service Changes, Interruptions and Termination
- Our services are provided in accordance with current technologies and conditions. We will do our best to ensure the continuity and security of the services to you. However, we cannot foresee and prevent other risks, including but not limited to force majeure, network, third party service defects, third party websites and others, which may cause service interruptions, unavailability of our services and other losses and risks at any time.
- In order to meet platform operational security needs, we have the right to determine the settings and scope of services/functions, modify, interrupt, suspend or terminate our services, according to specific circumstances.
Advertisements
- When you use our Services, we may send you relevant information, advertisements or branding services and we will display commercial and promotional or information (including commercial or non-commercial) from our software and related and/or third party vendors, partners on Bilicra Care.
- When you use Bilicra Care, we will send you programmatic advertisements based on your preferences, interests, etc. You can turn off programmatic advertising in the Bilicra Care settings. If you do this, the ads you see will remain the same, but the relevant ads will be reduced. You can read more in the Privacy Policy.
- We will advertise and promote relevant obligations in accordance with the law. You must evaluate and be responsible for the authenticity and reliability of the advertising or promotional information. as expressly provided by law and regulations, you are solely responsible for, and we are not liable for, any purchases, transactions, or damages or losses incurred or suffered as a result of advertising or promotional information.
Intellectual Property
- We own the intellectual property rights of the content (including but not limited to software, technology, programs, web pages, text, images, images, sound, video, graphics, layout, electronic documents, etc.) offered in our services. We also own the copyrights, patent rights and other intellectual property rights of the software we serve. No one may use the content of our services (including, but not limited to, monitoring, reproducing, disseminating, displaying, mirroring, uploading, downloading through any robot or spider program or device) without our permission.
- Texts, images, videos, sounds, etc. uploaded while using our Services are originally created or legally authorized by you. You or the original copyright owner owns the intellectual property rights to any content you upload or publish through Bilicra Care.
- In order to continuously improve and provide you with better services, you agree that the content you upload, post, transmit or disseminate on our services (including but not limited to texts, images, images, sounds or music, audio, dialogues and/or voices in videos) is authorized to us and our affiliated companies, companies we control, successor company and we have worldwide, free, non-exclusive, sub-licensable (through multiple levels) rights. The range of use includes, but is not limited to, existing or other websites, applications, products or terminal devices, etc. You acknowledge and agree that the grant of the above rights includes the following rights and licenses: content, content developed (in whole or in part) for any promotion, advertising and/or related marketing and other forms of content related to Bilicra Care and/or the company brand. You agree that the grant of the above rights also includes the permitted use, reproduction, display, transmission of personal images, portraits, names, trademarks, service marks, brands, names, logos, Company logos and other materials, etc.
- You agree to allow us to act on our own behalf or engage a professional third party to monitor infringement of intellectual property rights that you upload and publish, send letters of protection, file lawsuits or arbitration, mediation, conciliation, etc. We have the right to make decisions on rights protection matters and independently enforce them.
- We provide technical support for the development and operation of Bilicra.

It has all kinds of rights on all data and information generated during the development and operation of our Services to the extent permitted by laws and regulations.

Disclaimer of Liability
- Our Services may be affected or interfered with by various factors and we cannot guarantee (without limitation) that:
  - Our services are fully adapted to all user requirements;
  - Our services are uninterrupted, timely, secure, reliable or error-free, and any software, services or other materials you obtain from us will meet your expectations;
  - Any errors in our services will be corrected.
- If there are suspicious loans or other proprietary network information, account passwords, advertisements or promotions, please seriously consider and make a decision; we accept no liability for loss of profits, business reputation, data loss or any other tangible or intangible loss you suffer.
- When using our Services, you may encounter factors such as force majeure (meaning objective events that cannot be foreseen, overcome and avoided), including but not limited to natural disasters (such as floods, earthquakes, typhoons, etc.), government actions, wars, strikes, riots, uprisings, etc. If you do, we will try to repair it in time as soon as possible, while losses caused by force majeure will be exempted from liability under laws and regulations.
- We contractually acquire the right to deal with illegal content. This right does not constitute our obligation or commitment. We cannot guarantee that we will find illegal acts in a timely manner or deal with them appropriately.
- We do not provide any express or implied warranties or conditions of any kind about our Services, including, but not limited to, merchantability, fitness for particular uses, etc. You are solely responsible for the risk associated with using Bilicra Care.
- This agreement is to ensure compliance with national laws and regulations, maintain social order and protect the legitimate rights and interests of others, we will use our best efforts to make decisions in accordance with the relevant laws and regulations within our capacity, but it does not guarantee that our decisions are fully consistent with the decisions of judicial and administrative bodies. If so, you alone must bear the consequences.
- In any event, we do not accept liability for any indirect, consequential, punitive, incidental, special, indirect, punitive, incidental, special damages, including any losses you suffer while using our services. Whatever the cause, any liability we assume will never exceed the price (if any) you paid us for using our services during the membership period.
Special Agreements for Single and Third Party Services
- Our Services include links to information or information content obtained by Bilicra Care through various legal means, as well as other unique services legally operated by us and/or our affiliates. You may enable and use the individual services described above on SeTracke. Some singular services may require you to accept contracts specifically formulated for this purpose or other rules binding you and the singular service provider, if necessary, these contracts and rules are prominently presented to you when you plan to use the above-mentioned service for your review and approval. When you begin using the above services, you are deemed to have accepted the restrictions of the relevant agreements and rules for the individual services. If the terms of use are not specified or “perpetual”, “indefinite” or unlimited”, the terms of use of these products or services are from the date the user starts using the product or service until the date the product or service goes offline on Bilicra Care.
- When you use our services provided by a third party on Bilicra Care, in addition to complying with this agreement and related rules from us, you may also be required to accept and comply with the third party’s agreement, privacy policy and related rules. If the dispute, loss or damage caused by the third party software and related services is resolved between you and the third party, we are not responsible for you and the third party.
Terms of Use for Minors
- If you are a minor under the age of 18, you must carefully read this agreement under the supervision and guidance of your parent or guardian and obtain verifiable consent from your parent or legal guardian before using our services.

We attach importance to the protection of personal information under the age of 18, minors should strengthen their awareness of personal protection and take it seriously when filling in personal information and use our services when instructed by their parents.
Minors agree that you and your guardian will be responsible for all legal liabilities that may arise if you violate the laws and regulations or the content of this agreement.
Special tips for small users:
- Young people use our services supervised by their parents and should learn to use the internet within a reasonable range, avoid indulging in virtual internet and have good habits when surfing the internet.

- To better protect the privacy rights of minors, we must remind you to be cautious about publishing content that contains underage material. And also allows us to use and process content related to minors according to this agreement.

Other
- This agreement shall be governed by and construed and enforced in accordance with the laws of Turkey and the laws of Turkey shall apply to the settlement of disputes. If any provision of this agreement invalid or unenforceable due to conflict with the laws of Turkey, such terms shall be reanalyzed as closely as possible to the original provisions of this agreement and the other provisions of this agreement shall remain in full force and effect.
- This agreement is signed in Turkey. If you have any disputes with us because of this agreement, both parties should try to resolve them by friendly negotiation; if unsuccessful, you agree that the relevant disputes will be submitted to the people’s court in the place where this agreement was signed for litigation.
- In order to serve you better, our services will be updated and changed from time to time due to national laws and regulations and policy adjustments, we will amend this agreement accordingly and these changes are part of this Bilicra Care Terms. If updated, we will post an updated version of Bilicra Care and notify you of the updated content before the updated terms take effect, so that you can know the latest version of this agreement in time. You can also check the latest version of “Terms of Agreement” on the software settings page. If you continue to use our Services, you agree to the contents of this revised agreement.

If you have any objection to the revised terms of the agreement, please immediately stop logging in or using our services. If you continue to log in or use, you are deemed to acknowledge and agree to the revised terms of the agreement.

The headings in this agreement are for convenience and reading purposes only and do not affect the meaning or interpretation of any provision in this agreement.
We, the contracting parties, are independent subjects and in no event does this Agreement constitute any express or implied warranty or condition of our representation or interest in the user and the parties do not create an agency, partnership, joint venture or employment relationship.
